1. Acceptance of Terms

By creating an account, accessing or using any part of Spakto's services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.

2. Description of Services

Spakto provides cybersecurity intelligence and threat detection services, including but not limited to vulnerability scanning, threat monitoring, incident response tooling and security analytics. We reserve the right to modify, suspend or discontinue any aspect of our services at any time.

3. Account Registration

• You must provide accurate, current and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorised use of your account.
• You must be at least 18 years old to create an account.
• You may not create an account on behalf of another person without their explicit authorisation.

4. Acceptable Use

• You may not use our services for any unlawful purpose or in violation of any regulations.
• You may not attempt to gain unauthorised access to any systems, networks or data.
• You may not use our services to distribute malware, conduct phishing or engage in any cyber attack.
• You may not reverse engineer, decompile or disassemble any part of our platform.
• You may not resell or sublicense our services without our prior written consent.

5. Intellectual Property

All content, features and functionality of our services — including software, text, graphics, logos and trademarks — are owned by Spakto and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use our services for your internal business purposes only.

6. Payment Terms

Subscription fees are billed in advance on a monthly or annual basis as selected. All fees are non-refundable except as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.

7. Confidentiality

Each party agrees to keep confidential all non-public information disclosed by the other party. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

8. Disclaimers

Our services are provided on an 'as is' and 'as available' basis without warranties of any kind, express or implied. Spakto does not warrant that our services will be uninterrupted, error-free or completely secure. Cybersecurity is an inherently imperfect field and no service can guarantee complete protection.

9. Limitation of Liability

To the maximum extent permitted by law, Spakto shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of our services. Our total liability to you shall not exceed the amounts paid by you to Spakto in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to our services at any time, with or without cause, with or without notice. Upon termination, your right to use our services ceases immediately. Provisions that by their nature should survive termination shall do so.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by email or through our platform. Your continued use of our services after such changes constitutes your acceptance of the updated Terms.
